I know consumer laws might be different in each region.. But i would assume that most laws would protect you in this situation? A Pre-Order is simply a reserved copy of a game pre-release. The game is not released thus they can not deliver it to you, the product has not been used either thus allowing you a right to a refund? Has anyone actually been in this scenario? Whats happened? I assume they might be reluctant due to your account breaking ToS, but ultimately, the law is the law, right?
i dont think you should get a refund. if you wanted to take it further and you were banned for botting, i'm sure there is some sort of damage they can do to you. i dont see what the rush is for everyone to pre order it when its not going to be out for months AND there isnt limited copys either...
I appreciate your opinion.. But this topic is not about peoples personal opinions if you SHOULD have the right to a refund.. its more to do if legally you are entitled to one.. The "rush" is that you get a free level 90.
You can always have your Credit Card company contest payment for service not rendered. You are paying for a product that you will never receive - not the bonus crap you get up front.

Doesn't section 75 only protect you over £100? And isn't this regarding your credit card issuer backing you? This also seems to be limited to the UK? Is there something stating that they must offer you a refund without you having to go to your bank?
Not sure honestly. They can still allow you to have the expansion. You just can't use your banned account. The only thing I think you can do is contest it with your card company. But they might not allow it because it is a pre-order, and technically you haven't been denied the product. IF you've already used the Level 90 boost, then I'm afraid your out of luck. DX123
Your not buying a level 90 boost, that is given as a pre-order bonus. They allow you to refund WoD pre-orders if your are NOT banned, but it locks your boosted character. Also I'm positive that there has to be something quotable regarding this. Either being entitled to a refund prior to shipment/delivery, or them not giving you access to a product you have purchased that is not even released yet. They can add WoD to your banned account, but if your account is not accessible prior to them adding WoD I'm sure there is something. I'm asking all of this because it would be a good way to help save botters some money when pre-ordering.
The perils of being a cheater. They have your money and they consider the WOD to be part of the account banned. So unless you just preordered and did not specify an account they has your money. Consider this, if you account with WOD gets unbanned it will be ready for WOD. You bought the WOD and THEY WILL GIVE IT TO YOU ... it will just be on an account you cant access. Blizz can prove through paperwork that you bought it and they delivered it. So you are out the money. But if this is in the EU, who knows they got weird laws. Good Luck.
If I had pre-ordered and got banned I would ask for a refund and if they refused I would contest the payment by any means I could. The expac it not released yet so not sure how they can refuse a refund banned or not, you account was banned under a MoP licence and has not had the WoD apply and so it is unused. I got a refund by submitting a online request with my order number as I will not be playing WoD anymore and got a refund in a day. But who knows what will happen if you are banned.
You will receive WoD on the day of release, but you won't be able to use it - account will be banned. Its simple as that.
Its more that if you have purchased a product that has not been delivered and is not functional you should be entitled to a refund. If you request a refund 3 months before a product even exists you should be able to get one.
Getting a refund for the product would not be that hard as long as you don't agree with their ban and fight it. Blizzard is one-sided when dealing with banning people and are vague when they do ban people. They don't want people stating that they are banning just to make money and after they give your refund I would guess 8/10 use it for new account creation. So they get their money back in the long run.
