Last few months there was no other update on legal here, so lets do one. We had as far 2 cases going on, on 27th May in Leipzig - it is about my private liability - the ruling will be announced on 16th July It was a 3 hours hearing, but as far as i did understand the judge, there was not much to hold me liable to, at all. But we will see the whole picture when the ruling is out. on 5th June in Munich - it was about a declaratoryaction of over 500 banned WOW accounts, banned for reason of EULA/ToS, sdo we wanted to have a declaration action if this is even possible if there was no EULA/ToS in first place. But the court thoughts it is too abstract and we probably lost that one. It seems i need to do 500 single suits for satisfaction, looking where to do that at best. The main points for that case where that there was no EULA/ToS included in the contract, so there can be no cancelation of thelegal right of use , and if there where so i would at least need to get the missing money from the contract that did not get fulfilled. We still have the most important case in september, it was dated for 15th May but then the date was changed to 10th September, that are the appeals for Honorbuddy and Demonbuddy, but time flies by, so it is just few months till then. Now on 1st July there is also a important case in Hamburg, it is about if there is a contract between bossland and blizzard. We will keep you informed. There will be some decisions made this year, at least 3 important ones.
What do you mean with "If there is a contract between bossland and blizzard? Care to elaborate and explain some? Let's say you lose everything in court, will that lead to a force-shutdown on Honorbuddy and is the information on accounts that used HB in danger? thanks.
*There will be some decisions made this year, at least 3 important ones.* This is scary. Are you contemplating continuing this battle against blizz? I hope Bossland makes it through this time, and can continue to provide us service. I also hope this doesn't destroy you financially (by fighting them). Good luck - hoping for the best.
Specifically, I think it only pertains to bossland. All Blizzard/WoW Subscribers have no fight and are always banned if they get caught as an active subscription supposedly constitutes acceptance of the ToS/EULA. I believe the "contract between bossland and blizzard" is in reference to whether the program itself is contractually bound to the WoW/Blizzard ToS due to the program being designed for the game. It's a very difficult battle to win, and I believe the strongest defense is that the IP of bossland is not creating its own profiles and playing the game by itself but does require user input in a sense.
the most important queston here...is bossland going to give all its customer information over to blizzard ?
Why should we and which customer information? Board has not connection to key and even a key can be bought via PaySafeCard or Bitcoin if you want. There is no info to share and even if we have no intention to do so. We fight Blizz at the court, why should we spend money and time if we want to sell customer info? This whole question makes no sense.
Regardless of what happens, all you guys that make this program have my 100% support. I totally understand why blizzard is against botting programs but from someone that came back from Iraq with zero use of my left hand, the combat routines on here have allowed me to play a game that I never thought I would be able to play again. I know a lot of people out there use this bot to make money or just to grind out stuff but for some of us out there with disabilities it makes the game playable and fun again.
for me i use it for lazy raid i cant use my fingers so much i feel pain so it helps me a lot so i hope u guys win no bot no playing any more
I've always thought if it get's really hot with the court that the source be provided to a trusted third party so the bot doesn't go down like Glider did.
I think its more of a Fear that if you loose you will be Requested to Turn over the info, But what info would that be.. =)
Yes. Actually I was talking to BotOp and we decided that they will specifically only give your information to blizzard. Thanks for coming out, champ
if bossland needs money for attorny fees maybe they can do like a crowd funding where hb users donate to it
There are way to many open holes in Blizzard's claim and plently of counters. The case will most likely just drop due to lack of information against Boss.
Q: Bossland can we all go to court to get our banned accounts back? A: I actually plan the legal steps to do that in Germany, i will also support the ppl that want their account back or at least the not used gametime to be paid back, even if its 2 cents. Therefore i will prepare templates that i will purchase from lawfirms - so you guys, as long as you are germans, will have no much trouble to fill in and try for yourself to get what belongs to you. Q: There is something called privacy law. The only thing that can requested is the source of the bot. A: Your first sentence is correct, but the bot source code is copyright protected, only way for Blizzard to get it is to buy it. No court will decide uppon someones work to be given for free to someone else... Q: the most important queston here...is bossland going to give all its customer information over to blizzard ? A: No, and was never asked. But even if asked, no court will agree with that in Germany, this is a civil case. Q: if bossland needs money for attorny fees maybe they can do like a crowd funding where hb users donate to it A: We have a nice management here, myself, we can handle money An it is still and only about Germany, all decisions affect Germany only at this point.
