So after 3 accounts of mine got banned today I decided to have a little fun with a GM on live chat. I botted excessively on those accounts so I knew they would not last anyways. Made a good amount of gold on them so I am happy. But anyways here is the conversation that me and the GM had on live chat! Enjoy! Gm: I am here in assist players, there is a whole other team that deals with these types of things so I don't know the details on what they do on their end. you: ah you: shouldn't i get a refund for that bnet being banned? you: cause technically i purchased something and then it was taken from me you: Name one product in the US that can be taken from you once you legitimately pay for it. Violations of EULA's and TOS is not grounds to deny a customer use of a product they purchased, it amounts to fraud. On such a grand scale "King Pin" laws would apply, thanks to the RICO Act Racketeer Influenced and Corrupt Organizations Act Gm: If it was in normal policy for a refund we would but anything past 2 weeks will not get refunded. You used that account for 2 years so you do not get a refund for that. you: read above plz you: Blizz can influence quarterly sales by banning people for no reason, no evidence, only their word....thus forcing users to purchase new accounts. That is Racketeering ! Gm: I am not legal, if you think this is in violation, you need to contat a lawyer. you: i would like to see the evidence placed again wow4 you: it is a violation of law you: yes Gm: Then you need tocontact a lawyer, I can no longer dixcuss this if you want to take legal action. Gm: discuss* you: blizzard can ban you from live servers, they can't deny you access to a product you payed for. Which means they can make alternative servers for you to play your banned accounts on should you choose and if they wish to pay for the additional servers and cost, could be detrimental when the game has past it's hayday. Gm: It does say in the EULA you agree to that we can close an account for any reason or no reason at all. you: i didn't agree to the eula i never seen it Gm: So with that, is there anything else I can help you with? you: just wondering when the server will be up that i can use Gm: All servers are up right now. you: no the one for my banned account you: did you read my payment, it says I can get refunded for fraudulent purchases Gm: I am not discussing your banned account any further, I am disconnecting this chat if there is nothing else I can help with. yes, thats a good way to get blizzard to leave us alone and stop with legal action, spend time screwing with GM's.
As if they were going to anyhow? Edit: Pretty sure they made that clear with Glider and the 600k "euro" they payed as a retainer to the German courts.
I hope you were trolling them because they literally reiterated they can ban you for whatever reason, and you agreed to it one way or another or you wouldn't be able to pay for the game let alone enter it. The moment you mentioned legal action a GM is going to shut up really quick and your lawyer will get annihilated by Blizzard's legal team. It's really not a product, and you should skim through the Eula you did agree to.
I've been talking to some gm's in similar matters lately ^^ ofcourse I don't expect anything but I like giving them a hard time
indeed, and the part: "you: it is a violation of law" made me lol, and the part about the eula.. and that he didn't see it anywhere xD when you install the game, or simply just buy it.. you agree to blizzards rule set (end-user license agreement = EULA) too many people just click it because they want the game, without actually reading that shit real worlds law system isn't viable in a game, only in korea..
I am very well aware of all this lol. I was clearly trolling this gm. Nothing like some fun while me and botanist was jamming out on Skype. Also bewm I don't care what you think of my method of fun as long as I'm having fun.
This was dumb. You agreed to being banned whenever and for whatever reason when you click Accept when you first downloaded World of Warcraft. The GM is right. You are wrong.
I never said anything about being right or wrong. I could honestly care less if I was banned. Hence when I said I was messing/trolling with the gm!!

What some people here don't seem to realize is that just because something is in an agreement doesn't make it legal. If I release a product and in the disclaimer that no one reads it says that I now own their firstborn child and can sell it into slavery does not make it legal to do that even if they accept it as higher laws prevent it. I'm Canadian but I'm sure its the same in the US, State/Provincial laws cannot override Federal laws, just the same as Blizzards EULA cannot override consumer protection laws that exist in certain countries.
Take a screenshot. This looks entirely fake. The GM is entirely unprofessional with his grammar and wording and probably shouldn't be having these kind of discussions. I have a hard time believing it. Also you're ridiculously incorrect on the law side of this chat.
Either way man I get what you were trying to do here, some small vengeance for getting banned, a little fun, but this is just creating problems for you and for us in one way or another.
