Request a refund from Blizzard. They will happily give it. I have requested a refund for WoD twice and both times they quickly did it. (one time was I was quitting WoW, second time was account ban).

He never played the game he payed for and he now is excluded from that game. Therefore he can demand a refund since he couldnt break any ToS of that game since it wasnt even released.
I would demand a refund... definatly

"Closure extends to all characters and their associated property on the above license. Blizzard will not transfer or otherwise compensate any subscription time, purchases, or in-game value lost as a result of this closure."

In Germany we got something named "Rechtschutzversicherung" (legal costs insurance) with this insurance you can ask lawyers for free about your rights and get free consulting - even the possible lawsuit get's payed by this insurance.

Ich denke du wirst nichts falsch machen, wenn du deinen Anwalt einfach mal frägst. Mehr als Nein sagen kann er nicht. ;-)
i hope you get your money back :)

Doesn't matter. Blizzard still gives refunds regularly when asked or when forced by credit card companies (for this sort of issue.)

How in hell can't so many people in this thread understand such a simple notion. It's in the concept of Preorder itself.....if by any means they can't provide the pre-bought product, be it because of an account ban, an explosion on Irvine or the Internet imploding, they have to refund the money.

And that clearly applies to the fact that you are buying an expansion, not an Insta-level 90. That's added value to the expansion. Even if you already used the 90 power-up, you should still be refunded in case of a ban.

Honestly, I find it amusing that so many people use the "I can ban you with no reason lol" paragraph on Blizzard terms of shit as the second coming, yet they seem unable to understand their own rights and protections as a customer.

This thread is as stupid as I've seen on these boards...

Why are you asking us any of these stupid questions? ASK BLILZZARD!

You've been told time and time again to contact Blizzard, which it seems, you haven't done. You could've avoided all of this my simply contacting them first.

And you don't seem very bright...You said on the first page that you were going to contact a lawyer about this matter, but then you said that noone in Germany sues for this kind of thing. Why would you contact a lawyer if you have no intent on suing Blizzard? And why would you contact a lawyer BEFORE contacting Blizzard?

Doubt it, digitally prepurchasing something UPGRADES your account to be able to access future content. They don't have to refund you. Also why would you preorder something and then bot? Why wouldn't you just buy it when it comes out?...

      jeez. still arguing?
I was perma banned in one of my bot accounts and asked for a refund. I waited like 3hours and they changed it to a 72hours susp.
You can search in here for similar cases. And for a refund script mail you can search in mmo-champ site (they have there a thread with almost 100 pages full of tips and positive feedback)

Why would you do that? They don't have to provide you shit. They can ban you at any time, for any reason and they don't even have to inform you that you've been banned. Any communications to you after a banning is just a courtesy. They don't have to extend you any type of courtesy at all.
