      I've come to understand that anything involving a minor is up for interpretation by the the Judge.... talking about that is like discussing time travel. haha

      I decided against contracting more aids from you. So imma edit my long quoted reply.

      Your points are only valid IF:

      1. Blizzard shows evidence of what they have collected and the method they have used.
      If their method includes sweeping up other stuff not related to the detection of bots and if the data remains on their server its a violation of the data protection.

      Then again, from all your replies, you assumed 1 thing:

      Blizzard is honest when their EULA/TOS which says that they only scan for botwares only.

      They may very well be and they may have very well stuck to the scope and not more. And this is what folks here are interested to know, if they are specifically identifying 1 unique code that reveals HB. Or are they scanning a whole lot of processes including those of non unique to BOTs, and those DATA remained in their server.

      My points are all valid within the confines of the laws mentioned in a number of threads. I have only been referring to the laws that people have been providing and pointing out the language inside those laws which refute what people are trying to claim here.

      Again, there is no legal way for you to force Blizzard to give you the information that you seek. You waived your rights by giving them valid consent to scan your system for anything they want, within the confines of what you agreed to in their terms of service.

      You are the one making the accusations, so you need evidence that they broke any laws. What evidence is that?

      Their methods are protected by law. That data is protected and you cannot request it. It's the same reason you can't ask for the government to make KFC give up their secret recipe.

      Any data that they took was legally acquired because everyone who agreed to the terms gave them valid consent to search their computer for information. This is stated within the very privacy laws themselves. The laws state that as long as the companies have valid consent, they can collect the information, as I already mentioned.

      I am not stating my opinions. I am only telling you what the laws state. You're the one not understanding the laws. Go back and read them before you make more uneducated claims.

      what is "EC Data Protection Directive (95/46/EC), a data subject" for exemple ? it is a law ?

      I wana try to send a letter to but i'm living in france and i'm french, should i send it in english ?

      Also does anyont know what OP means with "If you are gonna use this, you must be from Europe. You are able to demand any vitual data about you be provided to you , and deleted". ? I didn't write anything like that in my letter. Do I have to write something about that I want them to delete any data? And if I do...does that mean that my account will be deleted :(?

      got unbanned too with these kind of letter send to Blizz (is nearly the same as OP).

      Got unbanned 30min ago after waiting 3 days :)

      I am from germany if anyone interessted

      Why?

      I hand wrote that letter, to the very word, and gave it to ICU for his thread.

      So, I have to wonder...ICU, are you making alternate accounts and spamming them?
      Because - and here's the funny thing...I wrote the letter with a lot of loopholes. It won't work, at all. It's absolute bullshit. It's a hoax, a scam, a troll if you will.

      And here the OP is, claiming it works. Well, I can assure you, ladies and gentlemen, it doesn't. I should know, I wrote the bloody thing.

      Actually no, OP. It wasn't written by an attorney. It was written by me. Stop lying, it's terrible for your soul.

      And here's the best part...after I sent it to ICU, I sent it to a user over Skype. Sephirofl might have shared it...but unlikely.

      Since I wrote this on Monday, three days have not passed - you haven't sent it, it never reached their offices, and furthermore, they didn't 'call' you, because a callback must be registered through a ticket - and the legal offices (which you apparently sent this to) will not call you back without a licensed attourney present.

      My issue is this: Blizz sent you an email saying you were banned. They sent you an email when you opened the ticket. They send an email when it is resolved (or closed, cancelled, etc). Why would they not send you an email saying your account had been unbanned? It's almost impossible to believe Blizzard wouldn't send you any kind of proof of what took place on your account. Why should anyone believe this story since you offer up no evidence proving this "unbanning"?

      You can read my previous comments on why he is lying - he didn't author the letter, nor did an attourney. I did.

      They will not, under any circumstances, overturn the current six month ban. They have irrefutable proof. Yes, you can request your information from them - go ahead! But it won't help. Your computer processes and RAM are not considered 'personal data' under the Data Protection Act.

      Even if he did get a call from a Blizzard GM, they would issue out digital proof of the account ban being overturned, through either an email or a ticket on their service.

      Everyone, please, understand that Blizzard is not overturning their bans. They are well within their rights, since they are not mishandling 'personal' data. You are welcome to see what personal data they have gathered on you - and it will just be a bunch of IP addresses, nothing more.

      Letters such as mine will just lead to a permenant account closure. They reserve the right to close your account at any time, for any reason.

      Well, whatever may be true or not. No one will know for sure unless tried. I just hand wrote a letter to Blizzard almost similair to OP. I will see what it brings me. If it leads to permanent account closure, then too bad. It will be the final reason to step away from this game. But I find worth a try. Besides, what would be the point of lying about this?

      Because some people like to troll. The thing is, Blizzard already stated that these bans will not be overturned FOR ANY REASON. They obviously had enough proof to ban us, we obviously were using HB, so why fight what you (technically) deserve? You weren't that concerned about being banned while you botted or you wouldn't have botted.

      The millions of dollars in retainer fees Blizzard pays their legal team annually probably guarantees your "legal" letters ends up in a special file.... the garbage.

      Will NOT work in the US. Data requests are ignored here due to the laws in which we have no rights to access the said data being taken by the company, per the agreement we all said yes to in the game.
