      i have no mistakes, i have facts. you haven't provided me with any german law that says otherwise other than " this is german law not american " just because its german doesn't mean the german law will prevail for hb. atleast until you can provide some facts saying so? and like i said from the beginning i'm not the one who said HB broke a copyright law. i just said US copyright laws can be enforced in germany in a german court.

      i honestly hope Hb does win , i love this bot.

      It seems you want to move the discussion into the realms of what the differences are between German and US copyright laws. I will leave it that there are indeed differences and if you wish to compare and contrast the two it's freely available at German Law Archive vs U.S. Copyright Office - Copyright Law of the United States and other easily googleable sources that I didn't think you'd need help in finding.

      Since we clearly disagree I will leave it at that. In summary; you think US copyright laws can be enforced in Germany in a German court (and think that is a fact), I think German copyright laws can be enforced in Germany in a German court (and think that is a fact). I now almost hope it's a lawsuit based on copyright (not only because HB would win) but also so we can see whether Blizzard is trying to enforce US Copyright law or Urheberrechtsgesetz.

      Maybe it's a bit strange comparsion, but if you play football with your hands instead of your food, it's not allowed either and you will first get the yellow card (3 days timeban) and then the red card (permban - well in football just for the game, maybe a few more and not for lifetime).
      The same counts for every other game as well. If it's Basketball, Tennis, Badminton, and so on. If you don't follow the rules and get an advantage to others, you will get defined with disqualification, even if you are playing this game for years.

      Actually the same happens here. Blizzard defines rules, which we accept by playing the game. If we are botting, we have an advantage against other players and will get defined with bans, even if it's sad about the time we've spent.

      Luckily I never have been banned yet, but I'm also not a hardcore botter and if I bot I'm not doing that do make profit at all. It's maybe just because I'm to lazy to farm the mats by hand and want to watch youtube videos in parallel. And if I'm getting banned I think I still can talk with the guys and tell them that I'm sorry and so on - from that point on I won't obviously do it anymore :)

      BUT I have to say, that from my point of view it's a 100% crap decision to sue now botting companies! From my point of view it's up to Blizzard to fix their product in that way, that botting is not possible anymore!

      By the way... Your examples are forbidden for completely different reasons! Xerox can't tell you to use Xerox paper for profit reasons! Blizzard doesn't make any bigger profit by excluding the botters... It's the other way around... If I hear some people have 9 and more accounts and are botting with them, they are paying blizzard every month. Those people for sure wouldn't have those 9 accounts, if they were not botting ;)

      One can make all the guesses one wants and puff one's chest about US law or German law.

      It all depends on court system, the judge(s) hearing the case, how good the legal arguments are, and how much (frankly) Blizzard is willing to throw at a small company to snuff them out of business simply because the small company cannot afford the legal fees. In the US the fees are much more of an issue and more than one company has been simply sued to death not because they did anything wrong, just because they couldn't keep up with the fees (I am frankly ignorant of the costs in the German system). The philosophy of the judge or court hearing the case also has a lot to do with the outcome (so much for justice being "blind").

      No matter what, a calm head about the matter will help in any case, and I hope truly Bossland the best in this. It will be interesting to see how much Blizzard's arguments track with the tactics they used against Glider, and how much they are willing or able to use that precedent in a German court system.

      I personally fail to understand how copy-write has any bearing on this case. If there is a German law on tortious interference with contract, they may have a case.

      this whole ordeal is absolutely amazing. i watched the rise and fall of Glider, i followed the case very carefully and i see a few things that HB did, that glider didn't that leads me to believe they have a fighting chance. They are based in Germany is the biggest factor. Law is different over seas and what we do in America, legally, has no bearing on what happens legally over there. Blizzard may have the US copy write act on their side but HB isn't in US. Hawker said in his interview with MMOwned that legal costs are a fraction of the price in Germany than they are elsewhere, which means, as he stated, it willl be much harder for Blizz to run them into the ground with court fees thus exhausting further debate in court.

      I really think this is a world first and a landmark case where the people's will can, and will, triumph over the corporate big pockets who always try to kick the little man where they are vulnerable. Chocolate, Nazis, and Honorbuddy vs. Blizzard is what Germany will be remembered for (so far) in history. LOL! Don't hate... everyone makes mistakes.... even blizzard.

      You're spot on with the observation's of the German legal system. Unlike the U.S. cases are judged by their relative merits and not by who can throw the most money at their argument.
