At least in the state of California, these are the violations that could be claimed:

Violating the Computer Fraud and Abuse Act (18 U.S.C. ? 1030(a)(2)(c)) - Only and if only they can claim a loss of over $5,000
Violating California Comprehensive Computer Data Access and Fraud Act (? 502)
Trespass (Trespass to chattels - this section applies to the server interaction since the Compuserv case)

These apply directory to ToS/EULA:
Breach of Contract (related to the PlayStation Network User Agreement)
Tortious interference

DMCA is no longer viable claim since exemption was added to the category of Computer games long ago. (Violating the Digital Millenium Copyright Act)

I doubt those could hold up in the court though. Claimed yes, won nahhhh.....

Was geohot convicted? I doubt it. Even if he will what he did was orders of magnitude different than selling WoW/D3 gold. Blizzard can claim losses all they want but they don't sell gold themselves. So they can't lose from it (yet, RMAH and all). It could be countered they benefit (botter subs, people that would quit if they couldn't find botted gold to buy subs etc etc). It's not so cut and dry i think.

Yup I agree with you 100%.
Us botting and putting up things in the RMAH, is essentially increase in the size of Diablo's market, which relates proportionally to their business model.
They'll try to maximize their profit, and it is in their interest to increase the amount of RMAH goods, whether they were generated by botting or not-botting.

This might be true. I do, however, see other things that would benefit the botting community / increase the income when implemented:

Selling characters. Huge when bots can run through every quest for you, get to 60 without you touching it and so on.
PVP. Gold prices will go up (a lot), people will want to get the good gear really badly.
RMAH will most likely also influence the value of gold, it's only speculation whether it will be positive or negative.

It all depends on how Warden is going to act, but I'm sure people will find a workaround for it.

 

I've said it before and I'll say it again...

The last time that the buddy team said that a product would be out on a certain day, that bot was delayed close to 4 months. The decision to delay the bot was made on the exact day they said they were going to release. That bot went live yesterday...

The dev's aren't very likely to make that mistake again, but I wouldn't expect them to give a date until you see a new thread with a link to the store where you can buy the bot.

RMAH can only help the plummeting prices on gold in my opinion. Im guessing there are 100's of people not wanting to buy gold from professional farmers due to being afraid of a ban or being scammed. It only opens up a new customer base who werent willing to buy gold "illegally". Or there will be a million people selling and it drops down to 25 cents per million.
