If anyone feels up to this, I think we have a very good chance of succeeding. The idea would be not to oppose the methods by which they detected the bot, but to argue against the EULA's which have to be apparent before a piece of software is bought. This is obviously not the case when you buy a piece of software from the store. Therefore, any reason for Trion that would make their stepping back from the agreement for sale legit (mind you, they are taking the PRODUCT from us, NOT just the account progress) would have to be of severe enough nature to make continuation of said contract absolutely intolerable. This is not the case with me botting a toon to level 43 (I have chronic tendovaginitis after all, do they really expect me to do 50 clicks per minute?).

Anyway, it wouldn't cost us very much if we did so, I estimate enough German users for this to be easily doable and with a massive banwave like this we are all in the same situation. I have seen this succeed once before with blizz and there's a chance we could get the very same lawyer for it.

If the developers support this, I would very much appreciate a mail to all German users pointing to this post. Botters unite yay!

Good luck to you, but I think that you are going a bit to the beyond side of the spectrum.

It would easily be debated that they did not take the product away from you, as you can still install it...

You just paid for a very expensive account login program..that tells you you're banned.

Don't waste any money on this you'll get destroyed as cases much larger than yours have failed and will provide them with paving blocks to unleash the rape on you. And you've seen this succeed with Blizzard how? Glider used the same methods and look where it got him, $6mil down.

No, I'm sure they don't. But on the same token, the 5'7 guards on my basketball team don't expect me to bring the ball up the court just as I don't expect them to dunk it when they have an open lane. People are different and with different abilities, if you have a condition that means it is difficult or impossible to do something, then don't use that condition as an excuse.

I thought Glider won the case in the High Court but another judge threw the case out of the window?

Just seems like a waste of time and it wouldn't be worth the hassle.

This as allways been an area i feel there is no legal ground by companies to ban key codes. Yes if you break rules and your account is banned, surely you have purchased a game and that keycode and therefore should be able to make another account with that key code? Ie we purchase the game software to play the game we then sign up for an account usually this part is free to do and to keep that account active you pay a monthly subscription, so surely if they ban an account, they surely legally cant ban your copy of that software forcing you to pay for a agame a second-third time?

Just re-read my post im hoping im making sence lol :p hope you understand what im trying to say.

There are always consequences for actions; if my drivers license is banned because I am speeding is that unfair? Not really because I broke the rules.

If I mod my Xbox 360 to get games for free and get banned, is that fair? Sure - I broke the rules.

      The list goes on.

      Poor examples tbh :p

very rare you get banned outright for speeding , usually 3 points and a £50 fine :p

Wasnt stateing it was or wasnt fair was trying to find out if it was deemed legal to ban the product aswell as the account, because by doing so renders that product useless, and it takes away any sell on available, which surely is every persons right to sell something they own? LOL just joking with ya now :p

      See your point Reghero :)
