Today, 10th July, court hearing Blizzard Inc. vs Bossland GmbH / Demonbuddy

This is the summary of the hearing in Hamburg a few hours ago.


The court gave both parties the opportunity to speak about their opinion and their view of facts.


The court also wrote up, how the contract with blizzard is being made, they used 3 points to define it.


First you buy Diablo 3, then you register and agree to the battle.net EULA & TOS and then on game start up you also agree on the Terms of Diablo 3.


The last 2 are, in my opinion, just 2 extra contracts that have no function at all but to limit the users and force them to sign wrapper contracts.


The court asked a lot of questions and got answers from both sides, and the court will decide on 17th July if the distributing and selling will be or will not be allowed in Germany.


What the court made clear, is that Demonbuddy can not be sold in Germany until then.


However, the injunction was never intended to apply outside of Germany. The Blizzard lawyers never explicitly asked the court to do so. This might have been a big mistake of the Blizzard Lawyers. They asked the court to set a penalty for at least 25.000 EUR for me breaching the injunction, by supporting Demonbuddy outside Germany.


In summary this means:


We are opening Demonbuddy sales tomorrow evening for everyone outside of Germany. Our Payment Provider needs to configure its servers with rules, that make more then sure that the court decision is being followed. I will test all that sets of rules, to make sure it is all right, and then the shop goes online for all our customers that do not live in Germany.


For the Germans, we still need to wait for what the court will rule on 17th July, and then we will inform you. If it is against us, we will fight it, if its in favour for us, Blizzard will fight the decision made by the court, so it still stays thrilling.


On a side node, the session doubling will not happen until the ruling was done, which means, not before 17th July in any way.


I was very happy with that court hearing today. It was interesting to listen, it is interesting for our internal analysis, and I am sure the reasoning in the decision will also be interesting.


To me and Hawker, the Blizzard guys and lawyers looked very unhappy after the hearing today; I might be mistaken, but who knows for sure.

Die Zusammenfassung der heutigen Anh?rung.

Es konnte sich jede Partei zu den Inhalten ?u?ern. Zum Vertragsverh?ltnis hielt das Gericht fest, dass es aus drei Teilen besteht. Dem Kauf von Demonbuddy, der Registrierung des battle.net Accounts und Akzeptierung der dazugeh?rigen AGB und beim Spielstart der Akzeptierung der Diablo 3 AGB.

Die letzten zwei Schritte sind meiner Meinung nach Schutzh?llenvertr?ge, die einfach nur die Bestimmung haben den Nutzer so weit wie m?glich einzuschr?nken. So sieht es meiner Meinung nach auch das neue EuGH Urteil vom 3. Juli 2012, welches die Rechte der Nutzer st?rkt.

Nachdem sich das Gericht einen ?berblick verschafft hatte, hat es angek?ndigt, ein Urteil zum 17. Juli auszusprechen und wir warten gespannt darauf.

Was das Gericht zu keinem Zeitpunkt meinte, ist dass der Verkauf von Demonbuddy au?erhalb Deutschlands jemals zu beurteilen war, das hatte weder Blizzard verlangt, noch w?re es in der Zust?ndigkeit des Gerichts gewesen.

Damit wird warscheinlich auch der Ordnungsgeld Antrag, der mich letzte Woche erreichte, abgelehnt werden. Blizzard wollte eine Ordnungsstrafe von mindestens 25.000 EUR gegen mich verh?ngt sehen, weil ich den Support zwar ausserhalb Deutschlands aber innerhalb der EU weiterhin aufrecht gehalten hatte.

Der Verkauf von Demonbuddy wird bis fr?hestens zum 17. Juli weiterhin in Deutschland nicht m?glich sein, f?r alle anderen L?nder ?ffnen wir unseren Shop morgen auf.

Je nachdem welche Entscheidung uns am 17. Juli begegnet, werden entweder wir oder aber Blizzard dagegen Beschwerde einlegen. Denn klein beigeben m?chte keiner.

Es war eine sehr interessante Anh?rung, hat mir noch besser gefallen als die WOW Sache im Februar. Die Antragstellerin ( Blizzard ) war heute nicht besonders gl?cklich, ich konnte es sehr deutlich an Ihren Gesichtsausdr?cken ablesen. Ich dagegen sehe endlich ein Umdenken bei den Gerichten und hoffentlich auch die ersten Urteile die die Rechte der Nutzer h?her gewichten, als ( frei denkbar).

Update: The court decided in favor of Blizzard and the injunction for Germany stays. In few days/week we should have the ruling, then we will appeal.

DE: Die einstweilige Verf?gung bleibt bestehen, sobald wir die Begr?ndung des Urteils haben, werden wir in die Berufung gehen.

Hopefully they will rule in your favor. I am happy that germany has a fair court system. I won my hague case back in march in germany when my ex wife kidnapped my son. And i am an american. Anyways, hope the summer over there wont be as bad ss last years for you.

 

I made myself very clear, when i will double the sessions.

 

What about exchanges. I just upgraded to 3 sessions honor buddy then was banned. I wanted to see if possible to release my honor buddy key for 1 diablo 3 key.

Well he can for non German customers, but whats the harm in waiting ? If the court rules against them on the 17th he can still double it for non Germans customers without any penalty if they rule for them everyone gets doubled at the same time. It's his choice when he does it and im fine with that.
