About two-three weeks ago i got banned, week ago i decided to try unban account, and after sending few tickets in which every single got declined ( they worked before many times for me, those letters... u know)
Account is about 5-6 monts old, it was used for botting until that february bans started, then it was idle until 5-6 days before it got banned. it worked LITERALY UP TO TWO HOURS a day with me being on same PC doing other stuff.
No i never used anything else but Honorbuddy.

1st mail was standard automated "abuse of economy stuff"

      Hey there!

Your account was permanently suspended due to use of third party programs, which is against the Terms of Use (Blizzard Entertainment: Battle.net Terms of Use), the relevant part of which can be found in this article :

      Battle.net Support

When running, the World of Warcraft client may monitor your computer's random access memory (ram) and/or cpu processes for unauthorized third party programs running concurrently with World of Warcraft. An unauthorized third party program as used herein shall be defined as any third party software, including without limitation any addon or mod, that in Blizzard Entertainment's sole determination:

      I. enables or facilitates cheating of any type;

II. allows users to modify or hack the World of Warcraft interface, environment, and/or experience in any way not expressly authorized by Blizzard Entertainment; or

III. intercepts, mines, or otherwise collects information from or through World of Warcraft. In the event that World of Warcraft detects an unauthorized third party program, Blizzard may

      a) communicate information back to blizzard entertainment, including without limitation your account name, details about the unauthorized third party program detected, and the time and date the unauthorized third party program was detected; and/or

      b) exercise any or all of its rights under section 6 of this agreement, with or without prior notice to the user.

The use of such programs or files is clearly unfair to the World of Warcraft community playing regularly and is not tolerated on our servers.

Following a review of your case, we can confirm that such program has been used on several occasions by your account, and that the subsequent action taken is appropriate. We would not look to enter into any further communications on this issue as the matter is now considered closed.

Please be advised that sanctions in relation to this matter will not be taken against any new accounts you may wish to create, but the characters from your cancelled account will remain irretrievable. If you should wish to create a new account, you will need to obtain a new and unused CD key with a retail copy of the game.

If you wish to review our current Rules and Policies, they can be found at:

      Battle.net Support
Blizzard Entertainment: Battle.net Terms of Use

      Kind Regards,

      XXXXXXXXXXXXXXXXXXXX

I was under the impression that they could no longer scan outside of their own processes.

Well, they have the 'power' for it, but they can't due new laws. So officially they don't, but unofficially they could do it easy. :)

Tell them that unless you get your account unbanned, you'll sue them for scanning your whole PC/processes which violates the privacy laws.

But the only way they'd now, so sounded like they knew this guy was botting was by scanning outside the process. Which is a big no no right ? or is there something I am missing and what they were doing is legit ?

It is illegal for any company to scan outside their own processes as it is a breach of privacy, DMW or DWM not exactly sure what it was called was sued by a man as he found their anti-cheat scanned his computer. He was hacking in COD2 but the cheats were found in a folder with photos of his baby so therefore he sued them.

I got this exact response when I got banned for gold selling 2 years ago, if you get banned and open a ticket a few times then eventually tell you the matter is closed and they no longer will discuss it.

What all does the WoW crash report send? I have a lot of crashes & request to send in crash reports from Blizz as of late. Of course I don't send in the reports, but just curious if users who send in these reports are unknowingly given Blizz this scanned info.

Think I'll just keep my bots on a separate machine from now on (as many have suggested before) and ignore requests for crash reports on all my machines.

If the gm admitted to scanning outside of their own process though, wouldnt that be admitting to breaking the law in an email? like thats proof and its stored on your mailbox and his.

      dont bot on your main?

They dont need to 'protect' you, they offer a cheat to help you in the game. If you cannot AFFORD to loose the account, dont bot. Make a 2nd, 3rd account, and dont bot on your main account. With shit like this going on, may be safer to use another computer to bot on and use your main on another. Depends how paranoid you are.

Most companies will completely stop contact with you as soon as you threaten them with a lawsuit...Which in turn will make sure you will not get your account re-activated.

Think about it, why would a company continue to possibly incriminate themselves after you threaten to sue them? Most won't...

And even if you win the lawsuit, they sure as hell aren't going to let you continue to play their game...In fact, they'll probably settle out of court with you and in the Non-disclosure agreement you'll be forced to sign, you'll agree to never touch their game again. And if you violate that contract, you'll never see a dime from Blizzard. And that contract will hold up in court compared to an EULA.

Yeah same here with the p?rox shit. I tried appealing that recently but a very angry GM reply said they wouldn't reply and that a lot of time and resources have been used to try and explain this to me xD. I open a ticket everyday LOL

if you cant handle getting cough don't bot.. you will eventually or at least the risk is high. I use a different computer a different ip a different payment method, and of cause different emails etc and no interaction between my main account and all my bots.. cause i would be very very sad if my main account god banned, my bots i dont give a shit about, if they get banned ill have a new level 85 within 6 days to replace it.. of cause i try my best not to get banned as it slows my business down for a bit, but i know it is a calculated risk, it only happened once EVER tho..

I work for the online portion of my company, and threats of lawsuits are always taken seriously and *never* ignored. If the issue isn't cut & dry (Ie. the person is trying to extort us), it is escalated to our consumer affairs and/or our legal department and they handle it from there or tell us how to respond.

Fastest way to find out if what they are scanning is legal or not, is to say you are going to file a lawsuit for illegal blah blah blah and see what they say. If you get blown off, then I would rest assured you don't have a legal leg to stand on. They're not blowing you off because you said you would do that, they're blowing you off because you will lose.
