Probably said before, but if everyone banned filed in Small Claims to get their $40 back it would overwhelm Blizzard as they have to show up in person and cannot send an attorney. LOLz Long live HB & GB you guys are awesome!!!
i almost did that lol, got like $1000 worth of gold off my accounts before my court date though so i didnt go through with it.. u can file for free if u dont have a job but its only like $20, the only problem is showing up in california. it would have been interesting to see what happens lol.. i dont think anyone has tried it before, but either way it would be a kick in the nuts for blizz just for 1 person to show up can file online here I-CAN!? This is actually really intelligent imho. 500+ people filing for court right around the time Blizz has to go to HB court...
btw in case u wonder how to get gold off your account after u get banned, keep it all in a gbank and after 1 month an officer can take over as GM, just make sure someone you trust is an officer.
or you can keep a vanilla account in your guild which is inactive with a high enough rank to move gold off. after you're banned, activate gametime (RaF works as you'll only need a few days) and move all of it.
i tried that, they banned the vanilla account too, i had ALL lvl 1s on the account and NONE even left the starting zone or touched any gold
first of all.. YOU are NOT the judge.. when i filed, it was because i had 4 months of prepaid game time cards applied to each account.. i didnt get to play those 4 months so i wanted it back.. but really all i wanted was the gold on the account cuz the game cards were paid for with gold anyways.......... it hasnt been done, it can be done and noone knows what the judge will say and i dont know why anyone on a botting forum would flame someone for trying it
It just comes down to the judge honoring the terms of use but I don't think blizzard should have the right to take your money. By clicking this button you agree that all your base belong to me and I don't have to give you what you paid for. It sounds criminal in my opinion.
The problem is Blizz hires a bunch of very smart cookies to write and word their ToS, no-one forces you to click "I AGREE" and in so doing if Blizz says you can only play our game hopping on one leg while wearing a pink tutu singing im a pretty little flower then i'm afraid thats what you have to do, realistically they enter into a contract with you but the contract is heavily biased in their favour, and if you fancy taking them to court in another country they will just hire a firm from the country you are in and you will end up with the expenses bill so what have they to lose not much i reckon .
Blizzard can be all powerful and have the best legal defense team, doesn't mean they can stop multitudes of filings in court. The costs involved in setting up a defense, flying a lawyer out to the area they are being sued, paying hotel, car rental, food, etc... for that lawyer... You add it all up and then complain about how this guy is saying he wants his gametime back... He is going to win unless blizzard likes to waste money to prove a point... But that's NO ONE's call. I doubt they would fight a small claims court filing based on the simple fact that the costs involved are much greater than just losing.
I went on blizzards website the other day. to transfer a character to another realm. and it says click now to pay with paypal. i clicked that, and they auto charged my paypal which charges my primary setting, which was paypal balance, then leads to a backup, which is my bank. well i had 2 banks... normally i would choose that Bank #2 when buying wow time, or if buying something on ebay. they some how made it so that when u click pay now, it auto charges you. as long as you are already signed into paypal. might take them to court for that... They robbed me! in a way..
this is stupid... If you really need to attempt to sue to get $40 back you're doing something wrong in life. You would most likely lose anyways considering you were caught botting.
Because its a stupid idea, also the last time you did start it you got banned for mouthing off to everyone on the forum. Except they will fight the first cases then use that judgement to render future cases useless, so they do and will spend money on court cases because for starters they are rich enough to hire good ones and because in the long run it makes sense to get favorable rulings. One small case might not seem important but they don't want to get a thousand cuts...
Are you seriously asking someone to think about what they are saying? lol. People thrive off coming to forums and just spewing shit out their mouths with no constructive critique. Every attorney I know pays folks to argue with them before they go to court. They WANT help to see the fallacies in their plans. On the forums, no so much.
