      So I have been thinking about this for a while and thought I'd make a post since I just had two accounts banned (ban virgin) :D

      An example:

      We go out and spend money on these games ($5 vanilla, $20 tbc, $30 wotlk, $40 cata). At those rough prices we spend close to $100 on the software to play this game. Then we have additional monthly expenses. So let's say we play for a few months after investing into the software and then we get banned. How does Blizzard have the right to deny us access to the software that we used? As far as I know I did not agree to any terms of use when I purchased the game, and when I did purchase the game after opening software no consumer can return it if we do not agree.

      What do you guys think of this line of thinking? Any loopholes from a legal standpoint?

      If you've logged into the game (only possible after accepting the EULA) then you've already accepted the terms of use.

      True, but when I purchased the software at $100+ dollars, installed it, up until then I did not accept EULA. So it is almost like we are forced to accept EULA as we have no recourse of returning opened software. This to me may fall under consumer exploitation AND I forget the name but may fall under a specific type of contractual agreement. LIke when oil change companies give you a form and on the back on pink paper there is a contract which is ver yhard to read in tiny writing. These contracts are not actually valid and do not release these oil change companies from liability in damaging you rcar.

      The full ToS/EULA is available on the battle.net website (as far as I know) and you can register for an account prior to purchasing. Not that I agree with the fact a company can prevent you from using something after spending $100 on it. If there was no purchase price and only a subscription then it would be fair but that's life...

      edit: Now I think about it I'm sure there's an additional "anti-*****ing" clause you must accept when you add a game key so disregard my first comment.

      Must seem like I'm beating a dead horse but I don't really care about the accounts, just musing about this :

      Regardless, if I go to best buy and buy this game off the shelf, pay for it, open it, try to install but do NOT accept the TOS - what can I do? I can't return it and I can't use the product. That is not fair to a consumer, IMO.

      I just pulled my Wrath box off the shelf and found this, in fine print, right on the top of the box where any normal human would break the seal to open their software:

      Seems like their lawyers thought of that, too.

      Your right, until u register the codes you can go through a bitchy process of returning what you bought. Also target takes swaps on opened video games including WoW, so buy wow use the keys, return it, swap for time cards. Do it erry day.
