The only case they won, was the stormbuddy case in which Blizzard illegally obtained code. This has NO relation to the HB case at all, it cannot even remotely be considered relevant. All HB and DB cases have been appealed by BOSSLAND, they have not been appealed by BLIZZARD. Why would Bossland appeal the cases? Because the outcome was not in favor of Bossland Lets take a look at the appeals they have publicly said they have done April 2015 Honorbuddy case regional court - lost 7/8 of the case, and appealed regional appeal court - lost 2/3 of the case and where granted to go to the Federal Supreme Court Demonbuddy case regional court - lost, no sales in Germany regional appeal court - lost, no sales in Germany Diablo 3 gold selling case regional court - lost the interim injunction(Blizzard later withdrew this injunction, but it has nothing to do with HB client or DB client) This is the latest legal update they have done with actual court information, take a look above, Bossland lost pretty much everything and appealed everything. Bossland is losing, look at the track record.
You do know this is the way the justice system is supposed to be working. Legal matters decided in lower instances can be carried to and be overthrown by higher court verdicts. One of the primary assignments of the German BGH is to review and weigh formerly spoken verdicts in civil or criminal cases - not on the basis of evidence, it merely decides whether the former verdicts were based on legal errors. Having said that, of course none of this gives any indication to the matter whether or not Bossland is going to win or not. One thing however isn't going to be the case - Bossland vs Blizzard will not be a never ending story.
Sorry mate, you seems to lack the idea of the actual meaning, the impact and the real consequences of the word "losing" in this case.
What are you even trying to say? Each case has had a majority loss to Bossland, and each currently decided appeal by Bossland have also resulted in a majority loss. So tell me where he is winning, you seem awefully biased, probably because this is your income.
diverting revenue from Blizzard to Defendants. How is it diverting revenue from Blizzard to Bossland??? Blizz still get thier monthly subscrition lol
Which is actually quite funny, nowhere has Bossland posted anything about the impact of his current losses, which probably goes to show its rather bad. I do not think it is too much to expect an injuction in EU against HB entirely, with severe losses paid to Blizzard. We will see in early 2017, im sure Bossland wont win, and he will be forced to let everyone know how bad it is.
While that may be true, the fact they made sure to blog immediately after Blizzard gave up on the injunction related to D3 gold. So it would appear the single sliver of good news was posted right away. To assume bad news is not posted in the same fashion by accident is just plain silly. The fact is Blizzard has won every meaningful case in terms of the direct impact to buddy users, several times now in several courts. It is much more common that the federal appeals courts upholds the courts and regional appeal courts findings than it is for them to rule against. Not unheard of, but considering the losses in the U.S to Blizzard by others in the past, and the fact it appears both courts so far agree with those rulings as well in 95% of instances, its not looking great.
ma·li·cious - characterized by malice; intending or intended to do harm. harm - physically injure I'd put that document in the shredder. It reads like communist propaganda.
You can throw that definition in the shredder, everyone knows in the IT world, malicious is used to define software that intrudes on other software, such as malware, or in this case a bot that injects into another piece of software
An IT lawyer that's writing for a website that covers these exact cases and gave positive points for both sides is sounding like communist propaganda? Did you and I read the same article?
You can exchange the communist word with anything you feel as offending enough, but it is propaganda, indeed. Those so called "IT lawyers" are nothing more than young students, exercising court cases here and there. The essay was quite one-sided, to be even close to objective. If visitors of the supreme court trial were close to being judges there, all the dogs outside the butchery would have became butchers too
Aion, you'r completely biased and have been blinded because of your bias. It's understandable as this is your income, but everyone should also take everything you're saying with an extremely large grain of salt, call it a boulder of salt. You can keep trying to make things look better for Bossland all you want, but right now, things are pretty bleak and it's actually pretty sad that you can't see that. You probably actually do see it. There's no reason for an IT lawyer to be trying to spread propaganda. If anything, they'd want the botting company to win. The courts aren't going to be a client to these lawyers, whereas, future botting companies may be.... I hope everyone that reads this thread realizes that.
The bot was active for about 6 hours before it received it's first banwave. Then after they said they fixed the issue, another banwave happened a few hours after it went live again.... I believe it was abandoned shortly after that.
You dodge to realize that its not a real Lawyer with practice etc., presenting a motivated stance, but just a young student instead. He can write anything in his blog and this is strictly his own impressions, as the same is clearly written in his blog's subscript. So anything me, you or others write on the topic is pure speculation, cornering with trolling ... Anyone, who have being in touch with the legal system and the courts do realize this.
Here's the footer...in English: Felix Hilgert is an IT lawyer at Osborne Clarke, advising companies from the start-up to the market leader in IT and e-commerce law, software contracts and all aspects of interactive entertainment. Can you show me exactly where it says he's a student? Can you show me exactly where it says he's not working for an actual lawfirm? BTW, here's the LAW FIRM he works for: Osborne Clarke Legal Services | Osborne Clarke Here's the SENIOR ASSOCIATE'S page on said website: Search Results Felix Hilgert | Osborne Clarke Again, your utter bias is showing through very clear here and the more you keep trying to discredit the author of the article, it's making your stance on this matter more ridiculous. Absolutely nothing about the article should lead anyone here to believe that this SENIOR LAWYER FOR A LEGITIMATE LAW FIRM is "trolling" anyone. Here's the article in question again in case anyone missed the previous link: Bossland vs. Blizzard: Verhandlung gegen Bot-Anbieter am BGH (1/2) Go ahead and read it yourselves and come to your own conclusions. Again, keep in mind that this guy has no reason to want HB to lose...HB losing is potentially negative for him and his law firm. There's no reason he'd be biased towards the courts.
